Even though these manuals were developed by Judge Magill for his own use and for use by other Town and Village Justices, they are still available for anybody else's use. We are finally caught up with the backlog of our orders. If you haven't order yet, please send your order in to us. If you haven't received your order and you placed the order before September 14, 2014, then there was a problem with your order. Some of the problems are: (1) Checks with no order form and no way to figure out which manuals that you want; (2) Voucher for one amount received after an order was shipped that order a different amount and has been paid; (3) Order shipped to either Judge or Court and then the other one faxes an order. Is it a mistake or do they want 2 orders this year; (4) Order already shipped and then a new order received that says revised; (5) Big problem--Attorneys fax an order without reading the notice on the form that says we no longer accept fax orders from non-governmental entities without payment accompanying the order. (6) Second check received for order already paid for. (7) check received with no notation and we have previous orders from Village Police Department, Village Attorney and Village Court. (8) People sending a fax with a question and order form and the answer to the question is on the order form. (9) Order received from Town with a different name than any order we received before. Is it a new order or the same order that we receive every year. Please be consistent with name that the manuals are ordered under as well as the address. I have one court that each year I have to change from the court address, to the clerk's home address, back to a Justice's address and so forth. The best address is the court address and if you have a P.O. Box, then please use it. It does speed up the order when it is mailed with ZIP+4.
These are just some of the problems. I chose the more frequent problems to show some of the problems we are dealing with. When we were so far behind, I could not take the time to handle the exceptions. Now that I am getting caught up, I will try to address the problems.

****NOTICE**** Pat informed me that one court clerk was swearing at her. I will not accept that kind of behavior. Especially from a COURT!!! Any court with that behavior will not receive any books!!
I am sorry to say that effective January 1, 2014, we will no longer accept non-governmental orders without the payment accompanying the order. Therefore, no fax orders will be accepted from non-governmental purchasers. I have just finished checking outstanding non-paid orders and many of the orders that haven't been paid are from lawyers who faxed an order and then didn't pay the invoice that accompanied the manuals or the second invoice that was sent to them. If I am going to continue this service, I cannot become a billing service.

Notice: Checks that I receive that are not accompanied by an order form or orders that require a Voucher to be signed or processed get put at the bottom of the stack of orders that I am trying to process. If there is no order, I have to spend extra time trying to figure out what exactly is wanted. I batch process my regular orders and orders with vouchers have to be pulled out of the normal stack and processed individually. Therefore, I have to give regular, complete order higher priority.
PLEASE CHECK THE HEADER ON YOUR FAX MACHINE!!! I receive quite a few faxes where the order form has been placed in the fax machine wrong side up!! Many Courts are using the fax machines that OCA has supplied to the courts. On the standard model, the fax has to be loaded FACE UP. I have received many blank pages and I have no idea who sent them (A lot of courts have not changed the header from HP Laser Fax to their Court name).
My Wife and I do this out of our home. Please try to be considerate and only call between the hours of 9 AM and 5 PM. My wife is usually home during those hours. I'm usually at Court in the mornings. The majority of our customers are kind and considerate and appreciate what we are trying to do for the Legal system. There is a small number of people who do not have good manners when dealing with other human beings. We will not put up with rudeness and inconsideration-we do not have to sell books to someone who thinks that they can be nasty and still get good service.
Starting with new orders, I will not be able to accept vouchers with a processing fee. Orders from agencies will have to be accompanied by a check or be willing to pay a processing fee of $3.00 if they submit a voucher. I will still accept Purchase orders but the receiving agency will have to make out the voucher and submit it. Most of the vouchers that I am asked to fill out state that the materials have been received and goods and services rendered. I cannot attest to that fact. Only the court or agency receiving the manuals can make that statement. In my court, I never send a voucher out to a vendor. I receive their invoice/bill and I complete a voucher, date, sign it and submit the invoice for payment. Any person or agency that doesn't pay will not receive any new manuals until previous bills are paid. I would be willing to wager that there are many companies that will not submit a voucher and will want payment up front. If I am wrong in this, please give me the section of the law that states otherwise.
Even if you fill out everything on a voucher except the signature line, it still take much more time to process your order since I print the orders, labels and invoices in batches. I have to go through and separate out any orders with vouchers before I fill the order and that slows the processing time. LIMIT ON NUMBER OF MANUALS THAT YOU CAN ORDER
Because I am doing this to help Town and Village Courts, I must limit the number of orders that can be ordered. I have a very hard time trying to estimate how many manuals to order each year. I don't want to order too many or else I would have to raise the cost and I do not want to do that. I have been getting requests from large state agencies that would very quickly use up my supply of manuals. Therefore, I am imposing a limit on manuals. I will only accept orders up to a limit of 25 of each of the manuals. I have to make sure that I have manuals for the small courts.
TRANSPORTATION LAW The Honorable Gary Graber, Judge in the Town of Darien and also a past president of the New York State Magistrates Association has done a lot of work with the Transportation laws. He has put together demonstrations at our state convention on how trucks are inspected. He had taken the data sheets that we have been given at past conferences and education sessions and tried to make them easier to use. He has given me permission to use those charts in my manuals. When I started to see how I would incorporate them, I felt that I needed to change the format and add information to what was available. Therefore, there is a section added to the Penal Law manual that covers pertinent information on the Transportation law.

Vouchers will not be accepted unless a $3.00 process fee is paid. An Invoice will be shipped with the manual and it is the court or agencies responsible to fill out and submit any paperwork necessary to have the bill paid. Future orders will not be shipped until all outstanding amount due are received.
MAGILL'S VEHICLE AND TRAFFIC LAW MANUAL--Judge Magill has been using this manual in his own court since 1988. He has fine tuned this to be the best manual to have on your desk when you are dealing with the Vehicle and Traffic law. The manual lists the sections of the Vehicle and Traffic law in numerical sequence. Each section gives the paragraph and sub-paragraph number of the section, what type of offense it is (Felony, Misdemeanor, Violation or Infraction), a short description of what that section is, the minimum and maximum fines for that offense, the minimum and maximum imprisonment, the number of points that will be applied to the offender's license and what the surcharge is. MAGILL'S PENAL LAW MANUAL with excerpts from TRANSPORTATION LAW--This manual is in basically the same format as the manual for the Vehicle and Traffic Law. It lists the sections of the Penal Law by section number with a short description of that section. It shows what type of offense the section is (Felony [A-I, A-II, B, C, D, E], Misdemeanor[A, B, or Unclassified] or Violation). The minimum and maximum fine along with the minimum and maximum imprisonment is listed. You are also told what the surcharge is and what amount of probation can be used for that offense. TRANSPORTATION LAW -This law is incorporated into the Penal Law Manual starting in 2008. This will cover the laws that most courts will see in their cases.
MAGILL'S ENVIRONMENTAL LAW MANUAL -
This manual has been cancelled since I can't even get DEC officers to agree what the fines are on different sections of the law. I cannot put out a manual that doesn't match the accuracy of my other manuals.
Judge Magill updates his manuals in February of each year. His printer usually requires 6 to 8 weeks to get all of the manuals printed so the new versions are usually available in March or April.
